ECKRICH “A HOUSE UNITED” TAILGATING KIT PROGRAM
TERMS AND CONDITIONS

These Terms and Conditions govern participation in the Eckrich “A House United” Tailgating Kit Program (the “Program”), sponsored by Smithfield Packaged Meats Corp., 111 Commerce St., Smithfield, Virginia 23430 (“Sponsor”). By submitting a request for a promotional tailgating kit, you agree to these Terms and Conditions. Submission of a request does not guarantee that you will receive a kit.

1. Eligibility.  The Program is open only to legal residents of the fifty United States and the District of Columbia who: (a) are at least 18 years old at the time of registration; (b) reside at a valid residential address within an eligible ZIP code identified by Sponsor; (c) have a valid email address; (d) agree to these Terms and Conditions. Providing an Instagram handle is preferred but not required to submit a request. Employees, officers, and directors of Sponsor, its parent companies, subsidiaries, affiliates, advertising and promotional agencies, fulfillment providers, and their immediate family or household members may participate only if expressly permitted by Sponsor. The Program is void where prohibited.

2. Program Period. The Program begins on at 12:00 p.m. Eastern Time on September 10, 2026 and ends at 11:59 p.m. Eastern Time on October 15, 2026 or until all available kits have been allocated, whichever occurs first (the “Program Period”). Because kits are intended for use in connection with participating universities’ homecoming weekends, Sponsor may close requests for a particular university before the end of the Program Period once the available kits for that university have been allocated or the applicable fulfillment deadline has passed. Any university-specific deadline will be identified on the Program website. Sponsor extend, shorten, suspend, modify, or terminate the Program at any time as provided in these Terms and Conditions.

3. How to Request a Kit. To request a kit, visit https://eckrich.sfdbrands.com/en-us/ promotions/ourhouse/ during the Program Period and submit the requested information, which may include your: (a) full name; (b) residential address; (c) email address; (d) ZIP code; (e) telephone number for delivery purposes; and (f) participating Big Ten university; and (g) optional Instagram handle. You must also confirmation that you meet the eligibility requirements and agree to these Terms and Conditions. Limit one request per person, household, residential address and email address. Requests generated by automated means, submitted using false or misleading information, or otherwise obtained through fraud or abuse are prohibited. No purchase is necessary to request or receive a kit.

4. Limited Availability; Selection of Recipients. Promotional kits are available in limited quantities. Sponsor currently expects to select approximately ten recipients associated with each participating university and may select up to twenty recipients associated with Michigan State University and the University of Minnesota. These quantities are estimates only, and Sponsor may adjust the number of recipients based on product availability, fulfillment considerations, the number of eligible requests received and other Program needs.

Submitting a request does not guarantee that you will receive a kit. This is a discretionary promotional product program, not a sweepstakes, contest, lottery, or random drawing. Sponsor will select recipients in its reasonable discretion based on factors that may include: (a) satisfaction of the eligibility requirements; (b) proximity of the applicant’s residential address to the applicable university or homecoming activities;
(c) delivery, fulfillment, timing, safety, and logistical considerations; (d) completeness, accuracy, consistency, and verifiability of the information submitted; (e) prevention of duplicate requests, fraud, abuse, resale, or commercial use; (f) if an Instagram handle is voluntarily provided, the social media review described in Section 5; and (g) for applicants associated with Michigan State University or the University of Minnesota, potential suitability for the optional content opportunity described in Section 5. Providing an Instagram handle may assist Sponsor in evaluating a request and may be considered as one factor in selecting recipients, but it does not guarantee selection. Sponsor is not required to select recipients on a first-come, first-served or random basis and is not required to disclose the specific reason that a request was or was not selected.

5. Social Media. If you voluntarily provide an Instagram handle, you authorize Sponsor and its service providers to review publicly available information associated with that account for purposes of: confirming that the account is authentic; evaluating publicly available content and engagement relevant to the Program; preventing fraud and abuse; evaluating safety and security concerns; determining whether providing an Eckrich-branded kit could create a material reputational risk; and selecting Program recipients. Sponsor will not request your social media password or require access to nonpublic account content. Sponsor’s collection and use of personal information are further described in the privacy notice referenced in Section 14.

Optional Content Opportunity. Applicants associated with Michigan State University or the University of Minnesota may be contacted about a separate opportunity to participate in photography, filming, or other content creation in connection with the Program. Expressing interest in or agreeing to be contacted about this opportunity does not guarantee selection for either a kit or the content opportunity. Participation in the content opportunity is voluntary and will be subject to scheduling, location, production, and other requirements communicated separately by Sponsor or its agency. Before any photography or filming occurs, each identifiable participant must sign an appropriate consent and release. A parent or legal guardian must sign for each participating minor, and the owner or authorized occupant of the filming location may be required to sign a separate property or location release.

6. Kit Contents. Each kit is expected to contain Eckrich-branded promotional merchandise, signage, and complimentary Eckrich products. Exact contents, sizes, designs, quantities, and retail values may vary.

Sponsor may substitute any item with an item of comparable or greater value and may omit any item that becomes unavailable. The kit is promotional merchandise and is not a “prize.” The kit has no cash value and may not be returned, exchanged, transferred, sold, resold, auctioned, or used for commercial purposes.

7. Delivery. Kits will be delivered only to eligible residential addresses within the designated Program area. Delivery may occur in multiple shipments. Sponsor may contact a selected recipient by email or telephone to verify delivery information and availability. If Sponsor cannot verify the information or obtain a timely response, Sponsor may select another recipient. You are responsible for providing a complete and accurate delivery address and for ensuring that someone can receive and properly handle the shipment. Sponsor is not responsible for: incorrect or incomplete addresses; failed, delayed, damaged, misdirected, or stolen deliveries; inability to access a property; packages left unattended; delays caused by a carrier, weather, or circumstances beyond Sponsor’s control; or spoilage or damage occurring after delivery. You must promptly inspect all food products upon receipt. Do not consume any product that is damaged, opened, improperly sealed, outside the indicated temperature range, expired, or otherwise appears unsafe.

8. Private Gathering. Receiving a kit does not require you to host a gathering. If you choose to hold a gathering using the kit, the gathering is independently organized, hosted, and controlled by you. It is a private gathering and is not organized, operated, staffed, inspected, supervised, or controlled by Sponsor.

Sponsor does not select or approve: the location; the property or premises; the number or identity of guests; food preparation or service methods; grilling or cooking equipment; transportation arrangements; entertainment or activities; or any alcohol that may be present. You are solely responsible for the gathering, the premises, your guests, food preparation, equipment, activities, transportation, and compliance with applicable laws and property requirements. You may not advertise or represent the gathering as: an official Eckrich event; an event hosted or supervised by Sponsor; an official university or conference event; a public event open to the general public; or an event endorsed by any university, athletic conference, or other organization unless Sponsor has expressly authorized that representation in writing.

9. Safety and Legal Compliance. You agree to use the kit and all included items responsibly and in accordance with all instructions, warnings, and applicable laws. You are responsible for complying with all applicable: food safety and food handling requirements; cooking and refrigeration instructions; fire, grilling, occupancy, and noise restrictions; parking and traffic rules; alcohol laws; local ordinances; landlord, lease, condominium, or homeowners’ association restrictions; and university or campus policies. You may not use the kit or any Program materials in connection with unlawful, dangerous, threatening, hateful, discriminatory, harassing, sexually explicit, or politically partisan activity. You must keep all products and promotional items away from children where appropriate and supervise the use of any equipment or merchandise.

10. Lawn Signage and Promotional Materials. The Program is intended to encourage selected recipients to display the Eckrich “A House United” signage included in the kit at their residences during the applicable university’s homecoming weekend. By accepting a kit, you agree to make a reasonable, good-faith effort to display the signage, provided that doing so is safe and permitted by applicable laws, ordinances, lease terms, homeowners’ association rules, and other property restrictions. You are not required to display signage if its display would be unlawful, unsafe, or prohibited by applicable property requirements. You may not: alter the signage in a misleading manner; add university, conference, team, sponsor, political, or third-party names or logos without authorization; use the signage to imply official sponsorship or endorsement; place the signage on public property or property you do not control; obstruct traffic, sidewalks, sightlines, or emergency access; or display the signage after Sponsor requests its removal. All trademarks, logos, artwork, and other Program materials remain the property of Sponsor or their respective owners.

11. Social Media Posting Is Optional. You are not required to post about the Program, Eckrich, Sponsor, the kit, or any gathering as a condition of requesting, receiving, or retaining a kit. If you voluntarily post about the kit, products, or Program, you agree to: share only your honest opinions and experiences; accurately disclose that you received the kit or products for free; make the disclosure clear and conspicuous within the post; and comply with the terms and policies of the applicable social media platform. Examples of appropriate disclosures include:

  • “Eckrich sent me this free tailgating kit.”
  • “Thanks to Eckrich for the complimentary products.”
  • #GiftedByEckrich

A disclosure should not be hidden among numerous hashtags, placed only at the end of a long caption, or otherwise difficult to notice. You are not authorized to speak on behalf of Sponsor or represent that your statements have been approved by Sponsor.

12. User Content. Sponsor does not acquire ownership of content you voluntarily post merely because you participated in the Program. If Sponsor wishes to repost, reproduce, or otherwise use your content, Sponsor may request permission separately through the applicable platform or another communication.

You may not post content that falsely suggests an employment, agency, sponsorship, or endorsement relationship with Sponsor, any university, or any athletic conference. Any separate photography or filming arranged by Sponsor or its agency will be governed by the applicable consent, talent, and property releases and is not governed by this Section 12.

13. Assumption of Risk; Release; Third-Party Claims. You understand that gatherings, cooking, grilling, food service, lawn displays, travel, and other activities may involve risks of personal injury, illness, death, property damage, or other loss. To the fullest extent permitted by law, you voluntarily assume all risks arising from: your decision to host or attend a gathering; the condition or use of the premises; the acts or omissions of you or your guests; cooking, grilling, serving, or consuming food; equipment or activities not supplied or controlled by Sponsor; alcohol obtained independently from Sponsor; and transportation to or from any gathering. To the fullest extent permitted by law, you release and hold harmless Sponsor and its parent companies, subsidiaries, affiliates, agencies, contractors, fulfillment providers, officers, directors, employees, and representatives from claims arising out of your participation in the Program or any gathering, except to the extent caused by a product defect, Sponsor’s gross negligence or willful misconduct, or any liability that cannot legally be waived. Nothing in these Terms and Conditions waives any rights or remedies that cannot be waived under applicable law.

To the fullest extent permitted by law, you agree to indemnify and hold harmless Sponsor and its parent companies, subsidiaries, affiliates, agencies, contractors, fulfillment providers, officers, directors, employees, and representatives from and against any third-party claim, liability, damage, judgment, or reasonable out-of-pocket cost or expense, including reasonable attorneys’ fees, to the extent arising from: (a) a gathering organized, hosted, or controlled by you; (b) the acts or omissions of you or your guests; (c) the condition or use of premises, equipment, alcohol, transportation, entertainment, or activities not supplied or controlled by Sponsor; (d) your violation of applicable law, property requirements, or these Terms and Conditions; or (e) your misuse of the kit or Program materials. This obligation does not apply to the extent a claim results from a defect in a product or item supplied by Sponsor, Sponsor’s negligence, gross negligence, or willful misconduct, or any liability that cannot legally be limited or shifted.

14. Privacy. Sponsor will collect and use personal information submitted in connection with the Program for purposes including: administering the Program; verifying eligibility; reviewing and selecting recipients using the factors described in Section 4; conducting the optional social media review described above; communicating with applicants; fulfilling and delivering kits; preventing fraud and abuse; maintaining Program records; and complying with legal obligations.

Sponsor may share personal information with its affiliates, advertising and promotional agencies, technology providers, fulfillment providers, shipping carriers, and other service providers that assist with the Program. Personal information will be handled in accordance with Sponsor’s Privacy Policy, available at https://www.smithfieldfoods.com/about-us/policies-disclosures/privacy-policy, and any point-of-collection privacy notice displayed on the sign-up page. Submitting a request does not enroll you in marketing communications unless you separately provide consent. Any optional marketing consent checkbox will be separate from acceptance of these Terms and Conditions.

15. Instagram Disclaimer. The Program is not sponsored, endorsed, administered by, or associated with Instagram or Meta. By participating, you release Instagram and Meta from any claims arising from or relating to the Program. Any questions, comments, or complaints concerning the Program should be directed to Sponsor and not to Instagram or Meta.

16. Disqualification. Sponsor may decline or cancel a request, refuse delivery, require return or destruction of a kit, or remove an applicant or recipient from the Program who: violates these Terms and Conditions; provides false or misleading information; attempts to obtain more than one kit; interferes with Program administration; abuses or threatens Sponsor personnel or service providers; uses the kit for resale, commercial activity, or an unauthorized public event; or engages in conduct reasonably determined to threaten the safety, integrity, or reputation of the Program or Sponsor.

17. Program Changes and Technical Issues. Sponsor may modify, suspend, or terminate the Program if fraud, technical failures, supply shortages, shipping disruptions, security concerns, legal requirements, or other circumstances impair the integrity, availability, or administration of the Program. Sponsor is not responsible for interrupted or unavailable websites, transmission errors, lost submissions, corrupted data, device incompatibility, or other technical problems.

18. Limitation of Liability. To the fullest extent permitted by law, Sponsor will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or relating to the Program, any kit, or any gathering. Sponsor makes no warranty concerning the kit or Program materials except any express warranty provided by the manufacturer and any warranty that cannot legally be disclaimed.

19. Governing Law and Disputes. These Terms and Conditions are governed by the laws of the Commonwealth of Virginia, without regard to conflict of law principles. Any dispute arising from or relating to the Program or these Terms and Conditions must be brought exclusively in the state or federal courts located in Norfolk, Virginia, and you consent to the jurisdiction of those courts.

20. Severability. If any provision of these Terms and Conditions is determined to be invalid or unenforceable, the remaining provisions will remain in effect, and the invalid or unenforceable provision will be enforced to the maximum extent permitted by law.
